Your Role in Workers' Compensation: Understanding Prosecutions and Reporting Offences

The responsibility of investigating and initiating proceedings for alleged violations of the Workers' Compensation and Rehabilitation Act 2003 (the Act) lies with the Workers' Compensation Regulator.

When a workers' compensation insurer encounters information suggesting a reasonable belief that an offense has occurred, the insurer is obligated to promptly furnish that information to Workers’ Compensation Regulatory Services.

Authorized Persons within Workers’ Compensation Regulatory Services will subsequently conduct an investigation into the potential offense to assess whether there is enough evidence to propose to the Workers’ Compensation Regulator that prosecution should be initiated.


Who is subject to prosecution?
