Decisions on Compensation Payments

In cases where the Queensland Industrial Relations Commission or Industrial Court determines that an insurer is not responsible for paying compensation to a worker or claimant, the individual who has received compensation is not obligated to reimburse the insurer (s.566).

It's important to note that this exception does not apply if the worker is convicted of fraud.

Employers are advised to communicate with their insurer to address and discuss the financial implications arising from the decision.
