Hazchem Industry Consultants – Your Guide to Ensuring Workplace Safety and Compliance

When it comes to seeking health and safety advice, People conducting a business or undertaking (PCBUs) have the option to enlist external consultants. These consultants often specialize in various areas, so it's crucial to choose one that aligns with your health and safety requirements. However, engaging a consultant doesn't automatically fulfill the legal duties under the Work Health and Safety Act 2011 for a PCBU. It's essential to recognize that a consultant may also bear legal duties as a PCBU for the services rendered.

The transfer or delegation of legal duties and responsibilities to a consultant is not permissible. Depending solely on a consultant's advice or recommendations might not serve as a defense if a PCBU is found in breach of their duties. Therefore, PCBUs engaging consultants for health and safety advice should stay actively involved in work health and safety matters, including the ongoing monitoring and review of risk controls.

In the realm of safe storage and handling of hazardous chemicals, providers offering professional services must demonstrate competence for specific tasks, such as designing storage and handling systems or authoring safety data sheets. The WHS Regulation defines a competent person as an individual with the requisite knowledge and skills acquired through training, qualifications, or experience. Although WHS laws don't prescribe specific qualifications for this sector, those engaging consultants should ensure that the provider possesses the necessary qualifications and experience for the task. When professional engineering services extend beyond the application of prescriptive standards, they should be carried out by a Registered Practicing Engineer Queensland (RPEQ) or under their supervision/sign-off, with expertise in the relevant discipline.

Major Hazard Facilities

Consultants who provide expertise and services in this area may be able to assist with major hazard facilities safety cases, form 536 (formerly form 69) submissions, safety management system development, emergency plan development and all areas of hazard and risk assessment including, but not limited to HAZAN, HAZID, HACOP, FMEA, QRA, LOPA, Bow Ties, fire safety assessment, chemical release consequence assessment and other services.

Consultants who provide expertise and services in this area may be able to assist with State Planning Development Provisions (SDAP) 3.0, chemical release consequence assessment, Preliminary Hazard Analyses (PHAs), Quantitative Risk Assessments (QRAs) and other services.

Storage and handling systems

Storage and handling system consultants can assist PCBU’s by providing design, construction and commissioning services for hazardous chemical storage and handling systems or compliance and auditing services for existing storage and handling systems (e.g. engineering advice and/or advice on compliance with Australian standards such as AS1940, AS1596, AS3780 etc.). These services may form part of an overall risk management strategy for a PCBU to safely manage hazardous chemical risks.

Accredited auditors for electrical equipment in flammable hazardous areas

The Electrical Safety Regulation 2013 also includes requirements for connecting or reconnecting electrical installations/equipment in hazardous areas to a source of electricity, including the requirement for such an installation accredited by a hazardous area auditor. A list of these hazardous area auditors is maintained by the Electrical Safety Office.

Aboveground storage and handling systems/facilities – design and installation
